Family seeks answers after police kill Texas woman at home

A white police officer who killed a black woman inside her Texas home while responding to a neighbor’s call about an open front door “didn’t have time to perceive a threat” before he opened fire, an attorney for the woman’s family said.

“You didn’t hear the officer shout, ‘Gun, gun, gun,'” attorney Lee Merritt said after viewing video taken from a Fort Worth officer’s bodycam during Saturday’s shooting of Atatiana Jefferson, 28. “He didn’t have time to perceive a threat. That’s murder.”

Her family told KXAS television that Jefferson was watching her 8-year-old nephew when she was killed early Saturday.

The Fort Worth Police Department said in a statement that officers saw someone near a window inside the home and that one of them drew his duty weapon and fired after “perceiving a threat.” The video released by police shows two officers searching the home from the outside with flashlights before one shouts, “Put your hands up, show me your hands.” One shot is then fired through a window.

“It’s another one of those situations where the people that are supposed to protect us are actually not here to protect us,” said Jefferson’s sister, Amber Carr.

“You know, you want to see justice, but justice don’t bring my sister back,” Carr said.

An aunt, Venitta Body, said the family does not understand why Jefferson was killed.

“It’s like from the moment we got the call, it’s been more and more inconceivable and more confusing. And there has nothing been done in order to take away that confusion,” Body said.

A large crowd gathered outside Jefferson’s home Sunday night for a vigil after earlier demonstrations briefly stopped traffic on part of Interstate 35.

Police Lt. Brandon O’Neil said Sunday afternoon that the officer, who’s been on the force since April 2018, is on administrative leave pending the outcome of an investigation and will be interviewed about the fatal shooting on Monday. His name was not released.

At a brief news conference at police headquarters, O’Neil confirmed that the officer did not announce he was police before he fired the fatal shot and that his failure to do so is part of the department’s investigation.

O’Neil also confirmed that Jefferson’s 8-year-old nephew was in the room with Jefferson when she was shot. He said representatives of the police department have spoken with the woman’s family and “shared our serious and heartfelt concern for this unspeakable loss.” Her family has said she was watching her nephew at the time.

O’Neil declined to answer reporters’ questions and said Fort Worth Police Chief Ed Kraus plans to conduct a more in-depth news conference on Monday.

James Smith, who called a police non-emergency number about the open door, told reporters he was just trying to be a good neighbor.

“I’m shaken. I’m mad. I’m upset. And I feel it’s partly my fault,” Smith said. “If I had never dialed the police department, she’d still be alive.”

Smith said Jefferson and her nephew typically lived with an older woman, who’s been in the hospital.

“It makes you not want to call the police department,” he said.

In an audio recording of Smith’s call that was released by police, the neighbor said it was “not normal” for the house to leave its front door open for hours at that time of day.

Merritt said Jefferson’s family expects “a thorough and expedient investigation.”

The Fort Worth Police Department said it released bodycam footage soon after the shooting to provide transparency, but that any “camera footage inside the residence” could not be distributed due to state law. However, the bodycam video released to media included blurred still frames showing a gun inside a bedroom at the home. It’s unclear if the firearm was found near the woman, and police have not said that the officer who shot her thought she had a gun. The police statement released Saturday said only that officers who entered the residence after the shooting found a firearm. Police did not immediately respond to a message seeking comment Sunday.

Democratic presidential candidate Sen. Bernie Sanders on Sunday called on the Justice Department to investigate.

“The killings of unarmed Black Americans have got to end,” Sanders tweeted. “Atatiana Jefferson should be alive.”

The shooting comes less than two weeks after a white former Dallas police officer was sentenced to 10 years in prison after being convicted of murder in the fatal shooting of her black neighbor inside his own apartment. Amber Guyger, 31, said during her trial that mistook Botham Jean’s apartment for her own, which was one floor below Jean’s. Merritt also represents Jean’s family.

 

Mom of slain Black man seeks new investigation into Amber Guyger’s former partner

A group of Dallas mothers is demanding a deadly shooting case involving the Dallas cop who had an affair with Amber Guyger be reopened after Guyger’s trial unveiled he destroyed evidence in her case.

Prosecutors revealed that Dallas police officer Martin Rivera, Guyger’s former partner, deleted text messages from the Sept. 6, 2018 night Guyger shot and killed Black 26-year-old PwC associate Botham Jean

The discovery has the Mothers Against Police Brutality coalition not only calling for the officer’s badge but for a new investigation in the death of a 20-year-old unarmed Black man Rivera shot and killed 12 years ago, according to The Dallas Morning News.

Collette Flanagan, one of the organization’s founders, spoke with the newspaper at a press conference Sept. 25. 

“He’s on oath saying he destroyed evidence,” Flanagan said of Rivera. “If you destroyed evidence for your lover, you certainly would destroy it for yourself.”

Although a grand jury failed to charge Rivera with a crime, the organization is hoping new policies put in place since the decision will work in its favor, such as one requiring the district attorney’s office to independently look into officer shootings, according to The Dallas Morning News. 

Brandon Washington was killed March 22, 2007, outside a Pleasant Grove convenience store, after a clerk accused him of stealing a candy, multiple news reports reported.

Rivera shot Washington in the head and leg after the man stalled in taking his hands out of his pockets, according to police records The Dallas Morning News obtained. 

The victim had a cellphone in his pocket, his mother, Antoinette Washington told the newspaper.

The woman, who spoke at the news conference, broke down crying when as she talked about her life since her son’s death news.

She said her son earned the nickname “Lil Wimp” as a baby because he struggled to lift himself up to crawl and that he didn’t have a violent history, according to The Dallas Morning News.

“It blew my mind to see him in another case,” Washington said of Rivera. “I knew he was no good then and justice is fixing to prevail because he killed my child for no reason.” 

Guyger was convicted Tuesday and sentenced to 10 years Wednesday for shooting and killing Jean.

she is the second officer in Dallas County to be found guilty of murder recently. Balch Springs officer Roy Oliver was found guilty of murdering a 15-year-old boy he shot while riding in a car with other teenagers leaving a house party, The Dallas Morning News reported

Before then, the county hadn’t seen a cop convicted of murder since the cop who shot 12-year-old Santos Rodriguez, in the head after handcuffing and interrogating the boy Russian roulette-style about a burglary, the newspaper reported.

That officer, Darrell Cain, served two-and-a-half years of a five-year prison sentence, The Dallas Morning News reported. 

Sara Mokuria, another Mothers Against Police Brutality founder, told the newspaper fatal cop shootings deserve to go to trial and that Guyger’s trial revealed the special treatment she received after killing Jean.

“Trials like this are extremely important because they lift the blue veil and show us what’s happening in the police department,” Mokuria said.

The father was devastated. He put his arms around his daughter, and begged for her forgiveness.

A little while later, the girl died in an accident. Her father kept the gold box by his bed for many years and, whenever he was feeling down, he would take out an imaginary kiss and remember the love of the child who had put it there.”

Donald Trump belittles Beyoncé, Jay-Z, Bruce Springsteen, invokes fans’ fury

 

Hip-hop and rock fans united in their condemnation of Donald Trump after the president went after Beyoncé, Jay-Z and “The Boss” Bruce Springsteen during a campaign rally in Minneapolis on Thursday night.

Trump bragged about the size of the crowds he attracted during the 2016 campaign and mocked his then-Democratic rival Hillary Clinton, who had a series of high-profile musicians perform at her events.REAL LIFE. “I didn’t need Beyoncé and Jay-Z,” said Trump. “And I didn’t need little Bruce Springsteen and all of these people.”

Trump then claimed, without offering any evidence, that musicians like Springsteen would sing two songs at Clinton’s rallies before leaving and taking most of the crowd, while “she is still talking in front of the same lousy crowd.”

The three artists haven’t responded publicly to Trump’s comments.

Springsteen has previously said Trump is “deeply damaged at his core,” but predicted he’ll win reelection in 2020.

Jay-Z has called Trump a “superbug.”

Trump’s comments were condemned on Twitter, where one person backed Beyoncé by saying said “it’s time to get in impeachment formation” and another showed support for Springsteen by telling Trump “you’re President of the United States but you’ll NEVER be The Boss.”

Democratic 2020 presidential candidate Sen. Cory Booker (D-N.J.) also chimed in:

‘Training Day’ prequel is reportedly in the works

The 2001 film “Training Day,” which starred Denzel Washington, has a prequel on the way.

Deadline reports the film will be set in the early ’90s around the time of the L.A. Riots, which started after four cops were let off after viciously beating construction worker Rodney King. The beating was captured on film from a nearby balcony by a man named George Holliday. 

At this point, there’s no word whether Washington will be reprising his role in some form or if Ethan Hawke, the original’s co-star, will be in it. Nick Yarborough, a new Hollywood writer, will handle the screenplay, but a director hasn’t been named yet.

Antoine Fuqua directed the original film which saw Washington play Alonzo Harris, a dirty narcotics officer, who’s knee-deep in the drug game and works directly with people in the underworld. 

Hawke’s character, Jake Hoyt, is a rookie officer who gets partnered with Washington, and he has no idea what he’s in for.

The movie takes place in a 12-hour span, and during that time officer Hoyt learns just what type of cop Harris is. He’s also put through some pretty harrowing situations.

Washington won Best Actor at the 2002 Oscars for his portrayal of Harris, which is the same year Halle Berry won Best Actress for the film “Monster’s Ball.” Hawke was nominated for Best Supporting Actor for “Training Day” but didn’t take home the trophy.

Others in the original include the singer Macy GraySnoop DoggDr. Dre and Eva Mendes, who played Washington’s mistress.

As for the prequel, it will show Officer Harris’ younger years, but it’s not known if the story will pick up once he was already corrupt or before that. The forthcoming project, which belongs to Warner Bros., is said to still be in its very early stages. 

In 2015 a TV version of “Training Day” aired on CBS, but it was cancelled after one season because its co-star Bill Paxton died of a stroke.
